In Domestic violence cases, when a court grants a protection order, it must make an order authorizing the issue of a warrant for the arrest of the offending spouse and suspending the execution of the warrant subject to compliance with any order imposed.   This warrant remains in force unless the interim protection order is set aside.  If it appears to a member of the South African Police Service concerned that there are reasonable grounds to suspect that the complainant may suffer imminent harm as a result of the alleged breach of the protection order by the offending spouse, the member must forthwith arrest the offending spouse for allegedly being in breach of the protection order.  If you would like to discuss this matter with one of our panel of divorce attorneys please contact Divorce Forms and we will be glad to help.
